Terms of Service

1. Overview
These Terms of Service ("Terms") govern your use of the services provided by Website Lab, LLC d/b/a Brightwork Digital ("we," "us," or "our"), based in Richmond, Michigan. By engaging our services, submitting forms on brightworkdigital.co, or receiving messages through our platforms, you agree to these Terms.
Our services include:
- Custom website design and development
- Google Business Profile setup and optimization
- Website hosting and ongoing maintenance
- Review Boost -- an SMS-based Google review request platform
2. Web Development Services
Service Description: We build custom, hand-coded HTML/CSS websites optimized for speed (95%+ Google PageSpeed scores), SEO, and mobile responsiveness. We also provide Google Business Profile setup and optimization for local search visibility.
Pricing Plans:
- Lump Sum: One-time payment of $3,000. 50% ($1,500) due before work begins, 50% due upon launch. Includes design, development, 5 custom pages, Google Business Profile setup, and basic SEO optimization.
- Payment Plan: $1,500 down payment plus $125/month for 12 months ($3,000 total). Includes all lump sum deliverables plus hosting, unlimited minor edits, and ongoing support for the duration of the payment term.
Add-On Services:
- Additional pages: $100 per page
- CMS and blog integration: $250
- Hosting (lump sum clients): $25/month
- Unlimited edits (lump sum clients): $50/month
3. Revisions and Edits
Lump Sum Clients:
- 3 revision rounds are included during the initial build
- After the 3 revision rounds are completed, additional work is billed at $60/hour
- A revision round consists of a collected set of changes submitted at one time
Monthly Subscription Clients (Payment Plan):
- Unlimited minor edits included: text changes, image swaps, contact information updates, Google Business Profile updates, and bug fixes
- Not included (billed at $60/hour): new page creation, new feature development, and major redesigns
4. Client Responsibilities
To ensure timely delivery, clients are expected to:
- Provide content, images, logos, and brand materials in a timely manner
- Respond to feedback requests and approve deliverables within a reasonable timeframe
- Provide accurate business information for SEO and Google Business Profile setup
- Submit update requests through our designated forms at brightworkdigital.co
5. Intellectual Property
- All website designs, code, and custom assets created by Brightwork Digital remain our intellectual property until full payment is received
- Upon full payment, ownership of the custom website code and design transfers to the client
- Third-party assets (stock photos, fonts, icons) are subject to their respective licenses
- Brightwork Digital retains the right to display completed projects in our portfolio unless otherwise agreed
6. Hosting and Uptime
Websites are hosted on Vercel's infrastructure. While we strive for maximum uptime, we do not guarantee uninterrupted service. Hosting availability is subject to Vercel's terms and infrastructure. We are not liable for downtime caused by third-party hosting providers, DNS issues, or circumstances beyond our control.
7. Review Boost SMS Program
Program name: Review Boost by Brightwork Digital
Description: Review Boost enables participating businesses to send a one-time SMS text message to their customers containing a direct link to leave a Google review for that business. Each message is manually initiated by the business operator.
Message frequency: Maximum one (1) message per request. This is not a recurring messaging program. You will not receive automated follow-ups, marketing messages, or promotional texts.
Message and data rates: Message and data rates may apply. Standard messaging rates from your mobile carrier apply to messages sent and received. Contact your carrier for details about your plan.
Consent: Messages are sent only after the business operator confirms that verbal consent was obtained from the recipient. Consent to receive a review request message is not a condition of purchase or service from any participating business.
Opt-out: You can stop receiving messages at any time. Reply STOP to any message to immediately opt out. After opting out, you will receive a single confirmation message and no further messages will be sent to your number.

Participating carriers: Messages are delivered via Twilio's messaging platform and are compatible with all major US mobile carriers including AT&T, T-Mobile, Verizon, and others.
Privacy: Phone numbers submitted through Review Boost are used solely for sending the requested review link. We do not sell, share, or use phone numbers for marketing purposes. See our Privacy Policy for full details.
8. Forms and Data Submission
Our website includes several forms for different purposes:
- Contact Form: For general inquiries. Submissions are sent to us via Resend.
- Onboarding Form: For new clients to submit business information, design preferences, and project details.
- Website Updates Form: For existing clients to submit change requests, categorized by scope (included vs. billable work).
By submitting any form, you consent to the collection and processing of the information you provide, as described in our Privacy Policy.
9. Payment Terms
- All prices are in US dollars
- Down payments are non-refundable once work has begun
- Monthly subscription payments are due on the same day each month for the 12-month term
- Late payments may result in temporary suspension of hosting or edit services
- Billable work ($60/hour) is invoiced separately and due within 30 days
10. Termination
- Either party may terminate the service relationship with 30 days written notice
- Upon termination, the client is responsible for any outstanding balances
- Website files and assets will be provided to the client upon request, provided all payments are current
- If a monthly subscription is terminated early, the remaining balance of the original $3,000 project cost may be due
11. Limitation of Liability
Brightwork Digital provides services on an "as is" basis. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to:
- SMS delivery failures or delays
- Website downtime or hosting interruptions
- Third-party service outages (Vercel, Resend, Twilio, Google)
- Loss of business, revenue, or data
- Search engine ranking changes
Our total liability for any claim shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising from these Terms shall be resolved in the courts of Macomb County, Michigan.
13. Modifications
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
